LUX EXPRESS JAX LLC — TERMS OF SERVICE

Introduction
Welcome to Lux Express Jax LLC (“Lux Express Jax,” “Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern use of our website, reservation system, vehicle rental services, chauffeur/transportation services where applicable, and other services offered by Lux Express Jax. By accessing the website, submitting a reservation, making a payment, checking the box indicating agreement to these Terms, or entering into a rental with Lux Express Jax, the customer acknowledges that they have read, understood, and agreed to these Terms.
1. Rental Eligibility
Customers must meet Lux Express Jax eligibility requirements before taking possession of a vehicle. Renters must provide a valid, unexpired driver’s license and any identification or verification information requested. Submission of a reservation does not guarantee approval. Lux Express Jax may approve or decline a rental based on eligibility requirements, identity verification, payment verification, insurance/protection requirements, driving qualifications, suspected fraud, vehicle availability, or legitimate business or safety considerations.
2. Age Requirements
Renters must satisfy the minimum age requirement displayed during reservation. Certain drivers, age groups, vehicles, or reservations may be subject to additional review, restrictions, fees, insurance requirements, or approval requirements. Meeting the minimum age requirement does not automatically guarantee approval.
3. Reservations
Vehicle reservations are subject to availability and final approval. A vehicle is not guaranteed solely because a customer submits an inquiry, application, reservation request, or payment unless the reservation has been confirmed through Lux Express Jax’s authorized reservation system. Reservation pricing, rental dates, mileage allowances, taxes, surcharges, protection products, add-ons, delivery charges, and other applicable charges will be disclosed during booking or in reservation documents.
4. Payments
Customers are responsible for all charges associated with their reservation, including rental charges, applicable taxes and governmental surcharges, approved add-ons, mileage overages, extensions, late-return charges, tolls, citations, fuel or EV charging charges, cleaning charges, towing or recovery charges, damage-related amounts, and other charges authorized under the applicable Rental Agreement. Lux Express Jax may use third-party payment processors. The customer authorizes payment of amounts properly due under their reservation or Rental Agreement using an authorized payment method, subject to applicable law and payment-processing requirements.
5. Cancellation & Refund Policy
Reservations are subject to the cancellation policy displayed at booking. The policy associated with the confirmed reservation controls the amount, if any, refundable after cancellation. Certain service, preparation, delivery, protection, processing, or other charges may have separate cancellation/refund rules when disclosed during checkout. Failure to appear for a scheduled rental without properly canceling may be treated as a no-show and may result in forfeiture of amounts permitted under the applicable cancellation policy.
7. Prohibited Vehicle Use
Vehicles may not be used for racing, speed contests, burnouts, drifting, reckless driving, impaired driving, illegal activity, transporting illegal/prohibited substances, towing or pushing another vehicle unless specifically authorized, rideshare/delivery/commercial transportation unless expressly authorized, operation by an unauthorized or unlicensed driver, intentional damage or abuse, tampering with safety/security/GPS/telematics/tracking systems, or any use prohibited by the Rental Agreement or law. Serious or repeated violations may result in termination of the rental and lawful vehicle recovery.
8. Speeding & Reckless Driving
Customers must obey posted speed limits and traffic laws. Excessive speeding, racing, reckless driving, dangerous operation, or other activity placing the vehicle or public at substantial risk may constitute a material breach.
9. Smoking & Vaping
Smoking and vaping are prohibited in all Lux Express Jax vehicles, including cigarettes, cigars, marijuana, vaping products, and other smoked/vaporized substances. Evidence such as odor, ash, burns, residue, or contamination may result in cleaning, deodorization, repair, loss-of-use, or other applicable charges permitted by the Rental Agreement and law.
10. Vehicle Condition & Inspections
Lux Express Jax may document vehicles before and after rentals using photos, videos, written inspection reports, mileage readings, fuel/battery levels, telematics, or other appropriate methods. Customers should inspect the vehicle before departure and immediately report undocumented existing damage. Vehicles must be returned in substantially the same condition, ordinary wear excepted.
11. Accidents, Damage & Theft
Customers must promptly notify Lux Express Jax of any accident, collision, theft, vandalism, impoundment, significant damage, or major incident. Where appropriate or legally required, customers should contact law enforcement. Customers must reasonably cooperate with Lux Express Jax, law enforcement, insurers, protection providers, claims administrators, and authorized parties. Responsibility for damage, theft, towing, storage, loss of use, diminished value, deductibles, administrative expenses, or other losses will be determined by the applicable Rental Agreement, insurance/protection agreements, and applicable law.
12. Insurance & Protection Products
Insurance and protection products are subject to separate terms, eligibility requirements, exclusions, deductibles, and limits. Purchasing a protection product does not necessarily eliminate all financial responsibility. Nothing in these website Terms creates, modifies, expands, or guarantees insurance coverage. Insurance priority and actual coverage are governed by the applicable Rental Agreement, insurance policies, protection agreements, and law.
13. Mileage
Rental vehicles may be subject to mileage limits. The applicable mileage allowance and any excess-mileage rate will be displayed during booking or in the Rental Agreement. Customers are responsible for mileage charges exceeding the reservation allowance.
14. Fuel & Electric Vehicles
Gas vehicles must be returned at the fuel level required by the reservation/Rental Agreement. EVs must be returned with the required battery level. Customers are responsible for charging costs incurred during the rental unless otherwise stated. Customers should not intentionally operate an EV until fully depleted. If an EV becomes disabled because the customer failed to maintain sufficient charge, the customer may be responsible for applicable towing, roadside assistance, recovery, or charging expenses.
15. Tolls, Tickets & Violations
Customers are responsible for tolls, parking tickets, traffic citations, towing charges, impoundment expenses, and other violations attributable to their possession or operation of the vehicle during the rental period. Administrative processing charges may apply where permitted and disclosed.
16. Rental Extensions
Extensions are not automatic. Customers must request an extension and receive approval before the scheduled return. Additional payment, authorization, insurance/protection coverage, or documentation may be required. Keeping a vehicle beyond the authorized period without approval may constitute a breach.
17. Late Returns & Vehicle Recovery
Vehicles must be returned by the date/time specified in the reservation or Rental Agreement. Late returns may result in additional charges. Lux Express Jax reserves the right to take lawful steps to recover a vehicle when a rental has expired or been materially breached, including unauthorized retention, fraudulent activity, prohibited use, unauthorized drivers, nonpayment, or circumstances creating substantial risk.
18. GPS, Telematics & Vehicle Technology
Vehicles may contain GPS, telematics, manufacturer-connected services, diagnostics, security systems, theft-recovery technology, mileage monitoring, or other vehicle-management technology. Information generated may be used for legitimate fleet purposes such as vehicle location/recovery, theft prevention, mileage verification, maintenance, diagnostics, safety investigations, claims administration, suspected fraud investigations, and enforcement of rental terms. Customers may not disable, disconnect, remove, damage, block, or tamper with authorized systems.
19. Cleaning
Customers must return vehicles in reasonably clean condition. Excessive trash, stains, spills, pet hair, smoke contamination, excessive dirt, biological contamination, or conditions requiring extraordinary cleaning may result in additional charges as authorized by the Rental Agreement and law.
20. Vehicle Availability & Substitutions
Specific vehicles may become unavailable due to accidents, mechanical problems, safety issues, recalls, delayed returns, or circumstances beyond reasonable control. Lux Express Jax may offer a comparable substitute vehicle, allow rescheduling, or provide any refund required under the applicable reservation/cancellation terms.
21. Delivery & Contactless Pickup
Certain reservations may qualify for delivery or contactless pickup. Additional identity verification, driver’s-license verification, documentation, photos, electronic signatures, or security procedures may be required before vehicle access is provided.
22. Personal Property
Customers are responsible for removing personal belongings at return. Lux Express Jax is not responsible for property forgotten, lost, stolen, or left inside a vehicle except where responsibility cannot legally be excluded.
23. Fraud & False Information
Customers may not provide fraudulent, altered, stolen, or materially false identification, payment information, driver’s licenses, insurance documentation, or other information. Suspected fraud may result in cancellation, termination, denial of future rentals, lawful vehicle recovery, payment investigation, or referral to authorities when appropriate.
24. Website Information
Lux Express Jax attempts to keep website pricing, descriptions, photos, availability, and other information accurate, but typographical, technical, pricing, or availability errors may occur. The company reserves the right to correct genuine errors before finalizing a reservation, subject to applicable law.
25. Third-Party Services
Lux Express Jax may use third parties for reservation processing, payment processing, identity verification, insurance/protection products, fleet management, electronic signatures, roadside assistance, or other services. Use of those services may also be governed by the third party’s terms/privacy practices.
26. Limitation of Liability
To the fullest extent permitted by applicable law, Lux Express Jax will not be responsible for indirect, incidental, special, or consequential losses resulting from circumstances outside the Company’s reasonable control. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
27. Rental Agreement
These Terms govern Lux Express Jax’s website, reservation process, and services generally. Every vehicle rental is also governed by the Rental Agreement issued for that reservation. The Rental Agreement may contain additional terms regarding insurance, protection products, damage responsibility, deductibles, mileage, vehicle use, fees, authorized drivers, return requirements, and rental-specific matters. If these website Terms conflict with the executed Rental Agreement regarding a specific rental, the Rental Agreement controls to the extent permitted by applicable law.
28. Governing Law
These Terms are governed by the laws of the State of Florida. Any dispute concerning a particular rental is also subject to applicable dispute-resolution, jurisdiction, and venue provisions in the Rental Agreement and applicable law.
29. Changes to These Terms
Lux Express Jax may modify these Terms periodically. Updated Terms will be posted with a revised effective date. Changes apply prospectively unless otherwise required by law.
